EL RANCHO TEEN COURT

December Teen Court 2015

12/7/2015

Case 1: In the first case the defendant went from stealing to drug abuse in a time span of weeks. It seems like he is escalating in crimes do you believe this defendant will make his probation or do you think his escalation in crimes will lead to a failed probation?

Case 2: Why do you think the defendant seemed to delay his answers? He seemed very slow when answering also his mother kept speaking to him before answering why do you think this was going on?

1. I think the judge talked sense into him because when he was explaining the consequences of a failed probation the defendant seemed scared and aware of the severity of the situation.
2.I think the defendant was have trouble with the comprehension of the questions because of a possible learning disability.

1) I believe that the defendant will make his probation; He seemed to only be caught up with drugs once. He seemed to know the consequences.
2) I think the defendant may have had learning disabilities because he was stuttering, and kept looking at his mom for an answer. He might have been uncomfortable

1) I believe, like previous cases, the defendent will follow through with his probation. The defendent seemed willing to change in order to keep his girlfriend, he seemed to be aware of the consequences, and he seemed to understand why he committed these wrongful doings.
2) The defendent illustrated signs of being a very shy person why'll he was being questioned, I do not think he was under the influence or trying to hide something. His mother was either trying to help him by telling him to explain more or she was not confident enough in his responses. I don't believe the mother had a very good connection with her son.

Case 1 I believe that he will make probation because he looked pretty scared when the judge was explaining the consequences of not making probation. I feel like he tried to make us feel sorry for him when he used drugs
Case2 I feel that he was still in shock that he was really in trouble and the consequences he has to face. I feel that he was trying to convince the jury that he didn't know what he was doing and that he thought he was right

1. I believe the defendant will make his probation. After a talk with the judge I think he understands what will happen to him if he gets into trouble during his probation period. I don't think that drugs have always been a problem for the defendant.
2. I think the defendant could of had a learning disability. If this is true, he might not have understood the context of the questions that were being asked of him. Due to this, his mother, most likely aware of his learning disability, was trying to simplify the questions to something he would understand.

1. He will probably finish his probation, but I think there is a possibility that crimes like the drug abuse will still continue throughout his life.
2. He did not fully comprehend the situation in which he was in. Whether it be a learning dissability or his views on his situation, it being that he did not think that something found was not considered stealing. I personally thing is latter because he kept on defending himself with that argument, he had not accepted he has committed a crime.

1. I believe the defendant will finish his probation because it seemed like his true meaning behind the crimes were for lack of communication with his mom and lack of father figure, other than his mom's boyfriend. Probation will help him get back on track with what's right.
2. I think the defendant had never really been in big trouble, so he was probably beyond terrified to be questioned about something he can't get out of. I also believe that he's always been under his mom's wing, so he never really had a chance to do something serious on his own.

1) To be completely honest, I feel as though the defendant will not make his probation because it seems as though the individual lacks in common sense and doesn't have proper guidance as far as his parents. It seems as though he does as he pleases, so in my opinion he will do something wrong again.
2) The defendant was slow to answer because he may have learning disabilities or maybe was too nervous or scared because of the trial and the constant numerous questions. He turned to his mother for answers because he felt as though he could not answer properly on his own. I just think he was rushing to get out of the court room as soon as he can and I believe that was the mother's intentions too.

1. I do believe that he will complete the probation because he looked disappointed and he seemed scared when the judge told him what would happen if he didn't complete it.

2. I think he delayed answering the questions because he was nervous and scared of what the jury and audience would think of him. Even though his mom said that she was telling him to speak up and wasn't telling him the answers, I do believe she was telling him because she talked to him for a long time before he would answer to the questions.

I do not believe the defendant will meet probation because he seems to be going in the wrong direction. The defendant quickly began to commit crime and with no support, then the individual will not be able to meet his probation.

I believe that the individual has some sort of learning disability because his mother kept on helping him answer and had to remind him to elaborate what he meant. Also, the individual's grades were not that good and even with the help of his mother, his grades should be higher than they were.

1. I do not think the defendant will follow his probation. Although the judge did talk to him I believe the defendant did not fully understand or chose to not understand what the judge was saying.
2. I believe the defendant was not comprehending the questions being asked of him. Possibly due to a learning disability.

1. I think that the defendant will make his probation because the whole experience he is going through right now will probably change his way of thinking which will cause him to do his probation.
2. The defendant was probably slow in answering and kept on looking and talking to his mother because of a possible learning dissability which made him nervous and scared which caused him to not be able to answer the questions properly and thoroughly.

1) I believe the defendant will make his probation because after learned the consequences, he seemed scared of what could happen if he did fail the probation.
2) I believe the defendant was slow in answering the questions due to a possible learning disability. It may have also been due to nerves or he was nervous being in front of a lot of people. I think the mom was just trying to guide his or help him understand what the question is.

1. His escalation in crimes might lead him to fail probation. He might be using the stealing and drug abuse to deal with his problems. Now that he was caught, and is in probation, he will most likely feel the pressure of those issues and somehow act out.

2. I feel like the defendant delayed his answers because he was trying to come up with lies to cover his story. Most likely, the mother was making sure her son didn't say anything that would put him in even more trouble.

I do no believe he will make probation. His excuses were weak and did not stay consistent with what he was saying showing that he was lying. On top of that if he was lying somewhere where he is going to be helped that just shows that he will continue to do the things he has been doing ending in a failed probation.

The defendant seemed to delay his answers only because it seemed he was very nervous. Just as well it may seemed a learning disability that has not been discovered may be playing a part in it. I think his mother was talking to him before he answered in order to give him answers desired toward his plea of innocence; his mother only tried to tell him what to answer so what his son answered was not something that would get him in even more trouble.

1. I believe he will not break the probation due to the fact that after hearing the consequence he won't go as far as breaking his probation.
2. I think the defendant delayed his answers because he wasn't sure on how to answer the questions so he kept turning to his mother for answers and possibly so he wouldn't say anything that would go against him.

Case #1 : In my honest opinion I do believe the defendant seems like he can go either way on failing his probation or actually learning from his mistakes. He seems to have no set rules in the household from his mother yet seemed frightened when the judge mentioned the consequences of failing probation. I don't see a clear path in my perspective
Case #2 : The defendant comes off to have a learning disorder in my view due to the lack of answers and his mother assisting him on the answers. The mother also seemed to be giving him the "answers" yet claiming to just "coach" him on telling him to just be "honest" as if the defendant couldn't decide that on his own.

1. I believe that the defendant will not make his probation because although the judge did explain the consequences it is though the defendant lacks the ability to think for himself and still isn't aware of the severities of the comsequences of his actions.
2. I believe he was delaying his answers because he had trouble comprehending the question and kept studdering. It was seeming as though he lacks common sense and capability of thinking for himself.

1.I believe the defendant will make his probation because he seemed to know the consequences of what will happen if he decided to not go through with it or if he would even think about doing it again.
2. I believe he was going slow on his answers and his mother was answering for him because he was not sure of the question and did not know what to say back so the mother helped out

1. The defendant is most likely to complete his probation, he has learned the consequences and knows that he will be sent to juvenile hall if he does anything to violate that probation. There is also a slight chance he might fail at completing his probation, he doesn't really seem to care.
2. The defendant took a long time to answer most questions, I believe there was a lack of comprehension, possibly a learning disability. The defendant probably didn't know what to answer, he still depends on his mother for everything; possibly wanting his mother to answer for him.

1st case: I believe the defendant is most likely going to complete his probation; although he is plummeting and his actions are getting worse as time goes on, but after the judge had talked to him about how his record could be clean after his probation he had a determined look on his face, I believe he will complete it.
2nd Case: the defendant seemed a bit droopy. And took a while to answer, his mother had talked to him prior to his responses. He seemed to ramble a lot, he could've possibly had a learning disorder. He probably needs mental help and relies on his mother to help him.

1. I believe he will not complete his probation time because he is influenced by bad things and he will be tempted to do drugs or other crimes .

2.i believe he didn't understand the question very good so he has trouble understanding certain things or words and I felt that the mom was telling him what to say so he won't be in that much trouble or to feel sorry for him

1. I think his escalation of crimes will not only prevent him from completing the probation but it will also take longer since he's done so many bad things in the past.
2. He possibly was really shy. However his mom probably tried to make him look good at a certain extent but overall the defendant is probably not good at public speaking.

I do not think he will complete probation because he is easily tempted to continue his bad habits.

I believe that he has a learning disability and his mother did not think he was capable of answering correctly and would get himself into more trouble

1) I believe the defendant will complete his probation because he seemed very aware of the consequences that could follow if he does not complete probation. Although, he seems to not care at the moment, I believe he eventually will which will lead him to successfully complete probation.

2) I believe the mother was helping him with his responses because of a possible mental disability and also, because she did not want him to get into deeper consequences.

1. The defendant seemed to understand the consequences, so hopefully he will make it to the end of his probation despite that seemingly fast escalation. However, I don't fully believe he will make it that long since he might be easily swayed by temptation.
2. It seems that he was rather dependent on his mother and really just wanted to leave as quickly as possible. The mother seemed to want to leave quickly too, and probably didn't think he was competent enough to answer questions without getting into more trouble. Plus there is the possibility of a learning disability.

1. I do think that he will complete his probation. I think will make better decisions from now on. Since he was caught so early on he will now now what the consequences for drug abuse and stealing are.
2. I believe that the defendant kept on delaying his answers because he may have been nervous, scared of saying the wrong thing and get more in trouble but also because like many people said of his learning disability. I feel as though his mom was maybe telling him the right things to say.

1.I believe that he will be in probation and will most likely be allured into keeping up with crimes.

2.From the defendant's stuttering it is evident, that it was not easy for them to speak publicly. For most of the session, the defendant relied on his mother to help him answer some of the questions that were addressed to him.
